Workplace discrimination is when an employee is treated unfairly based on race, gender, age, religion, national origin or disability instead of job performance. Also included under discrimination is reprisals for reporting violations. Almost everyone can agree that discrimination has no place in the business world, but not everyone understands the laws that protect employees against discrimination. Whether discrimination happens by accident or deliberately, the company could face very stiff penalties and other consequences. In order for a company to minimize discrimination claims in the workplace, the company needs to train all of its employees, as well as install a no tolerance policy. OSHA's Position On Discrimination & Diversity Training
The definition of “discrimination” involves any unfair treatment that is based on race, gender, age, religious faith, country of origin or disability. This applies most definitely to the workplace and OSHA has addressed this concern through their mandatory requirement that workers acknowledge and follow the Williams-Steiger Occupational Safety and Health Act of 1970 and U.S. laws against discrimination. This requires training in this area, because it is quite possible that discrimination can occur on different levels that many people are not overly familiar with, or occur even by accident. Not only is this counter-productive to the work environment, but it can lead to extremely expensive lawsuits. Imagine paying on a discrimination lawsuit based on an accident that was made because of the lack of readily available training! In addition, harassment in the workplace is also addressed by OSHA priorities and U.S. and State Law requirements.
