The state of NY recently adopted a Bill in State Legislature that will require contractors that work on public works projects to which the State or municipality is the party owner to have their entire workforce trained in the OSHA 10hr Construction Outreach Training Program. The Bill No. A02721A requires public work projects exceeding $250K in total contract work, to contain provisions which require all workers to have completed the OSHA 10hr Construction Outreach Training Course prior to going to work on the public works project by July, 18th 2008.

The New York State Dept. of Labor Bureau plans to enforce the statute come July 18th as follows:

All contractors and sub contractors must attach a copy of proof of completion of the OSHA 10 course to the first certified payroll submitted to the contracting agency and on each succeeding payroll where any new or additional employee is first listed. Proof of Completion may include but is not limited to:

· Copies of the bona fide course completion card; · Training roster, attendance record of other documentation form the certified trainer pending the issuance of the card. · Other valid proof
