Think of these Terms and Conditions as the general ground rules for using Atlantic Training’s services and website. They supersede any previous casual conversations or emails we may have had. However, we know business is specific. If you sign a specific Sales Agreement, Order Form, or Master Service Agreement with us, the terms in that signed contract will always take priority over these general website terms. If there is a conflict, your specific contract wins.
Payment Terms, Orders, and Quotes. Any quote we send you is valid for the duration listed on it (or 7 days if no date is specified). If we extend credit terms to your company, invoices are due Net 30 days from the date of delivery/access, unless your specific contract says otherwise. We appreciate timely payment. Overdue balances may be subject to a service charge of 1½% per month until paid. All pricing is in US Dollars.
Digital Delivery We have transitioned to a fully digital delivery model via our Wave platform. We no longer ship DVDs, USBs, or physical goods.
Cancellation & Refunds. Because our products are digital software and downloadable content, all sales are final once access is granted. Generally, this Agreement cannot be canceled without our written consent. Since we don't have physical inventory, there are no restocking fees. Any exception to this "No Refund" policy must be explicitly written into your specific signed Sales Agreement.
Force Majeure. We aren't liable for delays or failures caused by things beyond our reasonable control (like major internet outages, fires, government regulations, or acts of God).
Limitation on Warranty & Remedies. We provide our platform and training content "as is." We strive to provide accurate safety and compliance guidance. However, regulations change and every workplace is unique. Atlantic Training, LLC is not responsible for the misuse of information found in our trainings. You are responsible for ensuring that the training you select is applied correctly to your specific workplace hazards and regulatory requirements. Our content is for educational purposes and does not constitute professional legal or engineering advice. We do not guarantee that our training will prevent all accidents or lawsuits. Our total liability for any claim is limited to the purchase price of the specific service in question. We are not liable for indirect damages like lost profits or lost data.
Limitation of Actions. Any legal grievance (other than us not getting paid) must be commenced within one year of the issue arising.
Product & Content Updates. We are constantly improving. We may update, revise, or discontinue specific training titles or software features at any time. We will always aim to provide products that match the functionality described, but minor differences may occur as we upgrade our system.
Third-Party Products. If we integrate with a third-party tool, that tool’s warranty and support are provided by its original manufacturer, not us.
Software License. When you buy our training, you are buying a license to use it, not ownership of the code. You agree to follow the license agreement included with the product (e.g., using it for your internal business only).
Not For Resale. Unless you are an authorized Atlantic Reseller with a signed agreement, you agree that you are buying our services for your own internal business use and not for resale.
Export Control. Even though our products are digital, you agree to comply with all applicable U.S. export laws and regulations.
Our Remedies. If you default on your obligations (like failing to pay), we reserve the right to suspend your access to the platform and recover any costs (including attorneys’ fees) required to enforce these terms.
Indemnification. You agree to hold us harmless from any claims or liabilities arising out of your possession, use, or misuse of our products and services.
Governing Law. We are a Delaware-based company. These terms are governed by the laws of the State of Delaware, and any legal disputes will be handled in the courts of New Castle County, Delaware.
Ownership & Copyright. We take pride in our work. Atlantic Training owns the code, databases, videos, and all content on this site. It is protected by U.S. and international copyright laws. You may not copy, "rip," redistribute, or reverse-engineer our software or training videos. If you need to host our files on your own internal network, please contact us to discuss the specific licensing options for that use case.
