From famous entertainers, political representatives and even big industry leaders, sexual harassment is more common than ever.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Unfortunately, it has always been a reoccurring issue in the workplace environment.<\/span><\/p>\n<h2><b>So what is sexual harassment?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">When you hear sexual harassment the first thought that comes to mind is any type of gesture or comment that\u2019s offensive and is of a sexual nature.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sexual harassment is not just defined as unwanted sexual touching or inappropriate sexual remarks. Sexual harassment also includes discrimination against an individual&#8217;s gender or even gender preference.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, Susan is assigned harder tasks at work on a regular basis. John works in the same department as Susan and is always assigned easier tasks. John is given special treatment at work because of his gender. That\u2019s considered sexual harassment.<\/span><\/p>\n<h2><b>Who enforces these laws?<\/b><\/h2>\n<p><a href=\"https:\/\/web.archive.org\/web\/20200429055633\/https:\/\/www.eeoc.gov\/eeoc\/publications\/fs-sex.cfm\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">The EEOC (Equal Employment Opportunity Commission)<\/span><\/a><span style=\"font-weight: 400;\"> created a law in 1980 to protect employees and employers from sexual harassment in the workplace. This regulation defines sexual harassment and even states that it\u2019s a form of \u201csex discrimination\u201d which makes it part of the<\/span> <span style=\"font-weight: 400;\">Civil Act of 1964.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The EEOC sexual harassment regulation states It is unlawful to harass a person because of that person\u2019s sex. They go on to state that sexual harassment can include unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Anytime harassment is severe enough to create an uncomfortable and hostile work environment it becomes illegal. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is the EEOC\u2019s job to protect employees and employers from sexual harassment and discrimination in the workplace.<\/span><\/p>\n<img decoding=\"async\" class=\"aligncenter wp-image-45468\" src=\"https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/eeoc-logo.png\" alt=\"\" width=\"198\" height=\"198\" srcset=\"https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/eeoc-logo.png 720w, https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/eeoc-logo-300x300.png 300w, https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/eeoc-logo-150x150.png 150w, https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/eeoc-logo-125x125.png 125w\" sizes=\"(max-width: 198px) 100vw, 198px\" \/>\n<h2><b>What are the next steps?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Each case of sexual harassment is unique. Most companies will have their own policies and procedures set in place in the eve<\/span><span style=\"font-weight: 400;\">nt a harassment claim is filed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you are unfamiliar with these reporting procedures, ask your manager or your HR representative for more information. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Below are general steps to take when sexual harassment occurs at work.<\/span><\/p>\n<h3><b>1. Speak up and express how you feel.<\/b><\/h3>\n<img decoding=\"async\" class=\"size-large wp-image-45466\" src=\"https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/Speak-UP-1024x576.png\" alt=\"\" width=\"680\" height=\"383\" srcset=\"https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/Speak-UP-1024x576.png 1024w, https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/Speak-UP-300x169.png 300w, https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/Speak-UP-768x432.png 768w, https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/Speak-UP-1536x864.png 1536w, https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/Speak-UP-2048x1152.png 2048w\" sizes=\"(max-width: 680px) 100vw, 680px\" \/>\n<p><span style=\"font-weight: 400;\">The first step to stop the abuse is to speak up. Let the person causing the harassment\u00a0know exactly how uncomfortable they are making you feel. It\u2019s important as the victim that you communicate with the offender about what they are doing that&#8217;s crossing the line.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Calmly approach the offender and express to them that their actions are unwelcome and not appropriate. Sometimes the person doing the harassment doesn\u2019t even realize they\u2019ve pushed those boundaries.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Try not to approach the person with raw emotions or anger. Having a confrontation created by frustration will only cause more issues.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you feel uncomfortable speaking with your harasser due to what you&#8217;ve experienced have your immediate supervisor or manager step in.<\/span><\/p>\n<h3><b>2. If it\u2019s within your company policy you could be asked to fill out paperwork detailing your encounters.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Do not wait to report your harassment. Waiting to address the sexual harassment to your manager is a common mistake. The sooner the harassment is brought to light means the sooner the situation can be dealt with.<\/span><\/p>\n<h3><b>3. You can safely disclose the inappropriate situations you\u2019ve encountered with yo<\/span><span style=\"font-weight: 400;\">ur harasser.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Make sure you have proof of your interactions that involved harassment when you meet with HR. That can be written accounts, text messages, emails, letters and any kind of paper trail that can confirm your disputes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition, being able to accurately show the degree of your harassment will help your HR representative take the right course of action.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There are company complaint procedures set in place for when sexual harassment claims are set in motion. Your HR rep will be able to walk you through those steps and explain each phase in your companies procedures.<\/span><\/p>\n<h3><b>4. Documenting every encounter with the harasser is crucial. Write down and note all incidents of sexual harassment. Make sure to include:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Date<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Time<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Name of the offender<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Details of each encounter (what happened?)<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Words exchanged (comments and statements made by the harasser)<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Names of witnesses (who was around that can verify this exchange or situation?)<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Putting This information in writing will be critical when you need to present evidence of the harassment to HR.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As well as documenting the encounters with your harasser don\u2019t neglect to document each time you\u2019ve met with a manager or HR rep about the harassment.<\/span><\/p>\n<h3><b>5. If you\u2019ve exhausted your resources and are still unhappy with the outcome, contact the EEOC.<\/b><\/h3>\n<img decoding=\"async\" class=\"aligncenter size-large wp-image-45472\" src=\"https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/Contact-the-EEOC-1024x576.png\" alt=\"\" width=\"680\" height=\"383\" srcset=\"https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/Contact-the-EEOC-1024x576.png 1024w, https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/Contact-the-EEOC-300x169.png 300w, https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/Contact-the-EEOC-768x432.png 768w, https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/Contact-the-EEOC-1536x864.png 1536w, https:\/\/www.atlantictraining.com\/blog\/wp-content\/uploads\/2018\/10\/Contact-the-EEOC-2048x1152.png 2048w\" sizes=\"(max-width: 680px) 100vw, 680px\" \/>\n<p><span style=\"font-weight: 400;\">If the harassment continues and you aren\u2019t happy with how the situation has been dealt with, you have the right to alert the EEOC. As stated above, it is their duty to protect you from sexual harassment and discrimination in the work environment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The EEOC will conduct their own investigation once a claim is filed.<\/span><span style=\"font-weight: 400;\"> They will then decide how these grievances should be handled. The EEOC can choose to:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Close the case if they are unable to determine if the law was violated.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Suggest mediation between you and your employer to reach an agreement or settlement.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Send you a notice of \u201cRight to Sue\u201d, which gives you the right to file an official lawsuit against your company.<\/span><\/li>\n<\/ul>\n<h3><b>At the end of the day, we all have a right to a harassment-free workplace.<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Nobody deserves to feel victimized or uncomfortable in their workplace environment.
