Failing To Provide Safety Training In Spanish May Violate Equal Opportunity Laws

It is always considered good practice to train employees in a language that they can understand. Since 2007, it has been official OSHA policy since OSHA head Edwin Foulke stated, “Employee training required by OSHA standards must be presented in a manner that employees can understand.” However, is it also a violation of the Equal Employment Opportunity Act?

Twelve hispanic custodians at the state run Auraria Higher Education Center claim they are a victim of discrimination because their employer refuses to provide safety training, warning signs, and other communications in Spanish.

Represented by attorney Tim Markham, the group has taken their case to the EEOC who is now conducting a full investigation.

Campus spokesperson Blaine Nickeson defended their English-Only position by stating, “It’s not our goal to provide every document translated or every conversation translated. Our employees are expected to interact with members of the public and that interaction we expect them to be able to understand English,” said Nickeson.
